1.1. These Terms & Conditions (“Terms”) govern your use of our website and your booking of any courses offered through it.
1.2. By using the website or making a booking, you agree to be bound by these Terms. If you do not agree, please do not use the site.
1.3. We reserve the right to update these Terms at any time. Changes will apply from the date they are posted.

3.2. We may suspend or restrict access for maintenance or security reasons.

4. Course Bookings

4.1. All bookings are subject to availability.
4.2. A booking is confirmed only when payment is received and a confirmation email has been issued.
4.3. You are responsible for providing accurate participant information (e.g., age, medical conditions, swimming ability).
4.4. We reserve the right to refuse a booking if eligibility requirements are not met.

5. Pricing & Payment

5.1. All prices are stated in GBP (£).
5.2. Payment must be made in full at the time of booking unless otherwise stated.
5.3. We reserve the right to change prices at any time, but confirmed bookings will not be affected.

6. Cancellation & Refund Policy

6.1. Your cancellation

  • You may cancel a booking by contacting us in writing.

  • Refunds (full or partial) will be issued in accordance with our published refund policy 

  • No refunds are given for non-attendance unless required by law.

 

6.2. Our cancellation
We may cancel or reschedule a course due to:

  • unsafe weather or water conditions

  • instructor illness

  • insufficient participant numbers
    If we cancel, you will be offered a transfer to another date or a full refund.

 

6.3. Consumer Rights

Your statutory rights under the Consumer Rights Act 2015 and Consumer Contracts Regulations 2013 remain unaffected.

7. Participant Requirements

7.1. Some courses may require minimum age, swimming ability, or prior experience; these will be stated in the course description.
7.2. You must notify us of any medical or mobility issues that may affect safety or participation.
7.3. Participants must follow all safety briefings and instructions from instructors.

8. Safety & Conduct

8.1. Water sports involve inherent risks. Participants must behave responsibly and follow safety rules.
8.2. We reserve the right to remove any participant who acts in a dangerous or disruptive manner.
8.3. If removed due to misconduct, no refund will be issued.

8.4 We provide a range of appropriate personal protective and safety equipment

  • Buoyancy aids are mandatory when on the water

  • Suitably warm clothing for the conditions is required.

  • Helmets  are optional however they may be mandated by your instructor in certain conditions and if required must be worn.

8.5 You my use your own equipment but if your instructor has concerns about its condition or suitability they may require you to use centre equipment.​​

 

9. Liability

9.1. Nothing in these Terms excludes liability for death or personal injury caused by our negligence.
9.2. We are not liable for:

  • personal property lost or damaged during a course

  • indirect or consequential loss

9.3. You are responsible for ensuring you or the participant are physically fit to take part.

10. Intellectual Property

10.1. All website content, logos, images, and course materials belong to us or our licensors.
10.2. You may not copy, distribute, or modify any materials without written permission.

11. Data Protection & Privacy

11.1. We collect and process personal data in accordance with the UK GDPR and Data Protection Act 2018.
11.2. For details on how we handle your data, please refer to our Privacy Policy.

 

 

12. Third‑Party Links

12.1. The website may contain links to external websites.
12.2. We are not responsible for the content or practices of third‑party sites.

 

 

13. Governing Law

13.1. These Terms are governed by the laws of Scotland.
13.2. Any disputes will be subject to the exclusive jurisdiction of the courts in that region.
